I ended up conversing with Mr. Keough by email, these are the excerpts:

Q:I was wondering if you could tell me whether you have plans to pursue a patent grant on the delivery method? In my research I saw that Pharmacline was marketing Diabecline and that there were licensing/re-brandings of Diabecline with ThruPharma. These seem to have not materialized but I see that your Symphony and Reserve products are possible successors?
At the end of the day my purpose is to gain an understanding of the companies and current prospects of the drug, and who has license/patent/trademark/etc.. for it. I am interested because there seems to be two companies that are pursuing the tech, (Dakota Life Sciences and ViaDerma).

DAKOTA Life Sciences is still pursuing the patents, but we will not be using the Diabecline brand. We own the federal mark on it, and Phillips does not have a license to that mark


We believe in the core technology, and have solid plans to use it going forward. We did a voluntary recall in 2014 for the Diabecline branded antibiotic swab because the formulation was causing deterioration of the swab tip. We will not have that configuration going forward, but will be using and protecting the technology.


Phillips retained a small batch license for the technology, but his past practices have caused us to avoid being in any way affiliated with him.



Q:What does a small batch license permit?

Small batch is under 20,000 units per year

I emailed Dr. Phillips and ViaDerma. I heard back from Dr. Phillips who also told me he forwarded my message to ViaDerma. I have not yet heard back from Viaderma.

Dr. Phillips Response:

Q: [Can you] enlighten me regarding the licensing of some of the drug products you market. Specifically Diabecline and Tetrastem.

We have not licensed TetraStem.
We have non-exclusive licenses with two companies for Diabecline.


Q: Does Phillips have any restriction on their ability to license these to other companies for manufacture/production?

No restrictions.
No exclusive licenses have been written by Phillips Company.


Q: [Was told] Phillips Company had a small quantity license for Diabecline, from a company called ThruPharma. Is that something you can confirm?

Yes.
