You are correct- Symantec doesn't have it's OOBA patent. From one of Kay's email posted here, Symantec is infringing SFOR patent. Symantec only has '137 patent which is for detecting illegitimate out-of-band authentication attempts & as such no OOBA patent of it's own.

The 5 new Infringers coming up any day now - One could be Symantec and other could be Gemalto. Gemalto has 4300 patents, 6 related to Authentication but none for OOBA from what I have researched.

Also SFOR is one of the- Top 3 OOBA Vendors since September 2016
