My biggest fear is that the BOD has arrangements with a third party to get PVCT to file BK and structure it as a 363 CHP 11 sale which if approved by the court, means the board does not need shareholder approval to sell IP etc. Then, the assets go of to auction at pennies on the dollar and they have the third party sweep in and buy it up excluding the equity and other liabilities - essentially a court sanctioned FU to shareholders. The board as already entrenched itself and has proven to be shareholder unfriendly - they don't have our interests at heart. We need to be careful we don't let that happen as it's a real possibility in my opinion. What can we do to help as shareholders?

PVCT is a perfect situation for one or more activist investor to step in, buy up a meaningful stake in the company and impose their will on the BOD. That would probably result in a proxy contest to get these clowns kicked off and replaced by competent, trustworthy and properly motivated directors who share common interests with shareholders. So, reach out to any and all listed activist investor (hedge funds etc.) and alert them to the potential opportunity here with PVCT. What is happening here is exactly what they are looking for they just need it to hit their radars so they can be aware of it and do their due diligence to see if the opportunity is in fact right for them. Call them, email them, get the story in front of them in the hopes they like what they see and decide to step in and file a 13D.

Here is a list of approachable activist investors - use your ingenuity in a respectful way to alert them to what is happening to PVCT. This can work - I've seen it happen before!
