The 404 permit(s) they must apply for are CWA based permits. The unknown is if the EPA will command and EIS be completed or accept and EA. The expectation is that Nio will only need an EA. Nio seems to be taking their time with the application, probably so everyone involved is completely familiar with what they are doing and to reduce delays once they file. This is why I was telling certain people on here to use some common sense and not argue with Enviro's in the comments section of a certain article that came out after Nio got their JD. Don't poke the beehive or extra scrutiny is what you might end up with.

Now with TRUMP in, their process should loosen up. He has even made comments about eliminating WOTUS.
