What an odd view. I don't understand why you think the judge should have thrown the case out years ago, keeping in mind this is a judgment on a counterclaim. Dimension is the counterclaimant. Tmmi voluntarily dismissed its claim, so it's a little odd to criticize the judge for not dismissing it a second time. Strange appeal. But Dimension has smart lawyers. They must have come up with something better than this.

If the judge has found Tmmi to be liable for software theft, then there should be an award for damages. There isn't one. Did the judge forget? Or perhaps the allegation was dismissed and the judge did not find Tmmi liable for this.
