Perhaps they think that winning a license to use something they've been using for years isn't worth much, and would rather have cash. The problem with cash is that they lost all the claims for money, and hope to convince the judge that there has been an abuse so that they can at least get back the money they quixotically paid to their lawyers. The problem there is that they have withdrawn their abuse claim. Even if they restart it, they still need to prove an abuse. But perhaps they hope the judge will forget this. Perhaps they hope too that keeping the action going is tormenting enough for Tmmi to raise some dough or issue shares to settle.
