Grower to chime in on the legality, but I am pretty sure that if the CEO did " Negotiate in Good Faith" then the Doctrine of Latches" will not usurp LG's right even sans current suit.

I believe that negotiation by the CEO of LIBE (to BE the CEO of the survivor company) while acting defacto as "ECO-CAB" as well as LIBE is all that would be necessary to keep LG in play.

But then again, all I know about aphids, spider mites and terminal leaders.
