I think reasonable people properly informed would see this press release as churlish and infantile. The FFCOA affirmed a decision finding MaxD to lack standing. No ruling was necessary on mootness because MaxD lost on merits.

I guess there's one born every second -- but the bottom line is that MaxD lost. Google will now go after MaxD for costs. Google will likely demand upfront security for costs on new actions. Google will likely spend vast resources to seek to invalidate the underlying technology.
