Is LG Capital taking this case seriously?

There is another description of the LG Capital lawsuit on page 6 of the 10-K which provides a court location and index number for the case:

On September 15, 2016, LG Capital, LLC filed a lawsuit against the Company in the County of Kings, in the Supreme Court of the State of New York (index number 516298/2016).


The NY Supreme Court provides free electronic access to cases and filings, and one can search by litigant name or the index:

I searched using Liberated and the index number 516298/2016 and found nothing until I searched LG Capital, which provided the following list of cases:

There is no case listed as filed in Sept, 2016, but I think the reason for this is that the NY Supreme Court apparently doesn't put a case on the list until one of the litigants pays to file a Request for Judicial Intervention, so that a judge will get involved:

So if neither LG or Liberated files one of these RFJI forms and pays the fees, the case will sit in limbo.

If LG wants its money, why hasn't it filed one yet?

Perhaps they're waiting for the ExoCab deal to completely close and for Liberated to change its name.
