I agree with almost everything you posted except the capping of malpractice lawsuits. Some drugs can cause horrific lifelong disability and even death. How much value do you put on that hardship for the caregivers, family members, and survivors? If someone is maimed they may need care for life. It would be cruel to cap payments for care like that. I have a personal experience with malpractice as well.
In 2007 a dentist injected my lower jaw with an anesthetic, articaine, for a root canal procedure. He injected my lingual nerve and damaged it. As a result I had horrific burning pain in the right side of my tongue 24/7 for almost 8 years. I went to two oral surgeons who said nothing can be done and I'd have to live with it. No medication helped at all and I was becoming suicidal from the pain. I tried to sue the dentist but found out you cannot sue for such an injury. It is "inherent" in the procedure that it is risky and the dentist can never know if he is going to injure you or not. Just to get a little relief I would rub hot chili pepper powder into my tongue. After the burning stopped I'd get a few hours of semi relief. After much research and desperation I read that CBD oil can help regrow damaged nerves. I started taking it and within 6 months was 70% improved. After a year and a half I was cured. No doctor on this planet would have recommended or even known about that. I missed several weeks of work because of the pain, especially the first couple of months. No reimbursement for that, no relief, and no compensation from the dentist. THAT is why I will oppose caps to malpractice.... if a doctor injures you because of their malpractice or due to the medicine they prescribe, they must be held to account.
