Fair point on the stage of the case here

As long as you have an active case you are subject to what might be coming down the pipe and that is what our appeal sets us up for. I think for those cases that have been finalized through appeal and are done then they are just out of luck, but if you are alive then that could bode very well for you going forward. Time delay at this point is on our side.

I'm no lawyer but this "could" be the case, again I don't know the answer but your argument seems logical for sure.
