One way to find out is to contact the company. Since they already made the announcement in the 8K, it would not be a problem asking the company for clarification of their comment in the 8k. They certainly won't be able to say it hasn't been made public. Asking for clarification of a public statement is a legit question.

If enough ask, they will have to answer or, the comment stands as fact in the 8k. I believe there is only one way to take that statement or they gave it up as a condition for maybe exclusive rights for so long but certainly not worth 25M shares if that is the case.
