Not disagreeing. No question that the original lawsuit got off on the wrong foot and was something of a disaster. I'm not sure though that the lawyer who argued the appeal is the same lawyer who handled the lawsuit. This one seemed critical of the way the lawsuit was handled, and the way the original licensing agreement was written.

But I don't think anyone reasonable would think that the lawsuit went well and was well handled, even if the appeal is successful. On the other hand, there are folks who spin tales (with hoos hoos, and Oh mys, etc) suggesting that every mishap in the litigation is all part of a grand strategy, etc. I doubt this is true.
