What I took from it is that AdvisorShares is saying that they agreed on the settlement based on the fact that the settlement would remain sealed and that the information Thomas needs can be had if they just amend the confidentiality clause and allow him access to the info he needs. The info he needs would be amount received in the settlement (or due to receive). Who that settlement was paid to (or who it will be paid to). When was the settlement paid (or when will it be paid). It also says that they attempted to talk with Thomas' legal advisors about making an amendment but haven't had a response.

So in my opinion their main point was they are ok with giving Thomas the information that he needs, but only the information he needs.
