I will be waiting to see if Teper actually files the appeal. I wouldn't be surprised if he decides not to pay for it by the Jan. 11 deadline and executes the reverse split instead.

Again, the stock is also subject to delisting over the stock issuance this year without shareholder approval. We're left in the dark as to whether Nasdaq has accepted the company's plan to remedy this, or whether its decision is pending. I doubt that that panel will look kindly on Teper's maneuvering over the price delisting issue.
