Does anyone have concrete proof that NERG is under investigation?

Yes, as concrete as we can get at this point.

NERG was suspended by the SEC for suspicion of fraud. The SEC's preliminary investigation uncovered enough evidence of fraud to result in a suspension of trading of the stock. Stock suspensions for fraud automatically result in any SEC investigation being upgraded to formal status. Those investigations can take up to 5 years to resolve, and really never take less than about 2 years to complete in even the quickest investigations.

NERG was suspended 7 months ago. We can be quite sure the formal SEC investigation is active and continuing.
