In my opinion the judges shredded your case in oral arguments! I listened already and the lady judge especially sunk your case and says as much several times. She said "death knell for your case" when making her main point! Basically she was saying that to overcome a prior art rejection on the 336 the lawyers at the time made a huge and clear disavowal of patent scope. Your lawyer could not argue his way out of it imo. He seemed to have no answer that satisfied the lady judge. Oh and your lawyer totally did a horrible judge stating your case and could not articulate how the 336 works!

Also telling was only the magar prior art was addressed they did not even touch Sheets! I believe the reason for this is your case is basically sunk by the magar disavowal that the lady judges said the inventors of the 336 probably did not even need to do but they did she felt clearly!!! So she seemed to be saying as clear as day she felt that the 336 is stuck with a huge disavowal of claim scope

In my opinion you will lose this case. Still time to listen and SELL!
