In the general device market would it be better for a company seeking FDA clearance to have all other legal issues resolved before the FDA decision, and if so is it possible the FDA have been asked not to publish a decision until that time?

In a similar vein could aforementioned company secure new licencing deals on the back of the held up FDA clearance?

Just trying to work out what is happening!
