Remember, if ALL final POR 7 is NOT followed precisely, the releases are invalidated, so does JPM/FDIC REALLY want to travel down that road or follow TOTALLY SECRET, court sealed and agreed to two month Mediation result? I believe that is very easy to answer considering what people have to lose. Read on!


***The Claim***

WMI and now the Trust has an agreement in the GSA to satisfy a 'The Taking'. Yes, there is a TOTAL "check and balance" to ensure people do NOT forget what the agreement was/is!

"In its capacity as a creditor, WMI claimed, among other things, that the FDIC dissipated WMB’s assets by selling substantially all the assets of WMB to JPMC rather than liquidating WMB’s assets, and thus the FDIC breached its statutory duty to maximize the net present value return of such assets, and therefore owes damages to WMI; (ii) the FDIC’s wasting of WMB’s assets constitutes a taking for property without just compensation in violation of the Fifth Amendment to the US Constitution; (iii) the FDIC’s refusal to compensate WMI for the property taken in the receivership constitutes a conversion of WMI’s property, actionable under federal law; and (iv) the FDIC’s refusal to compensate WMI of property taken in the Receivership constitutes a conversion of WMI’s property"

After reading this section of document #5885, it's my opinion that the Fifth Amendment Taking is already resolved.



My, this kind of filing and part of the final POR 7 agreed to by the court on 2/23/2012 makes me LOVE my Escrow Shares MORE, MORE, MORE and MORE everyday!
