Agree with your post 100%....not sure how calculated he was, as I believe that there was some guidance in the background on some of it, but end result the same.

However--I was not referring to the Europe expansion debacle, but rather press releases regarding international sales that were put out well before the Europe ones. If you state that your product is being distributed--or is available for distribution/purchase--in a certain area of the world, then any prospective investor should be able to believe that the correct paperwork had been completed, and appropriate government approvals had been granted, and that the product can actually be legally sold there. Let's face it--if I tell you that I have...say a distributorship....set up in China, then you have every right to expect that I am supporting that distributor with product....at least samples, at the minimum. If I have NO export license, then it is patently obvious that I can have NO distributor set up in China.

To the best of my memory the company never issued a press release that product was available in Europe--therefore the "paper trail" defense you refer to is practicable....shady, but "plausible". The releases I am thinking of were well before Europe, and--if memory serves--did state that the product was available there.
