- Mr. Laxague, as well as Attorney Arash Shirdel for the Plaintiffs, participated by telephone.
Court noted age of the case and that Mr. Austin had previously anticipated trial taking more than 2 weeks.
Mr. Laxague stated it would be at least 1 week.
Mr. Austin stated he does not think trial will take too long as there is only one counterclaim and
the other side has identified only one witness,
Mr. Cavanaugh, for trial;
he believes his side can put their case on for 2 days.
Upon inquiry of the Court,
BOTH SIDES WAIVED the JURY,
and anticipated 5 days for a bench trial.
Colloquy between Court and counsel regarding the scope.
Court stated the estimated length of trial will be determined at the October 27, 2016
hearing date for motions or at Calendar Call.
All counsel are REQUIRED to ATTEND Calendar Call;
however, they do not need to bring their exhibits that day.
Proposed findings of fact and conclusions of law need to be SUBMITTED
in Microsoft Word format to the Department by the morning of trial.
Parties are also welcome to submit trial briefs,
which must be served on the other side.
