Maybe the deposition was added to the filing to give shareholders a real snapshot to what happened.

I don't think money in the bank right now matters for a merger. Wasn't Seth looking at 3D company to merge with prior to becoming non reporting? Lack of money didn't stop DECN from wanting to merge, did it. DECN supposedly was even willing to give Seth the insurance settlement.

I wouldn't be worried about the money, but hope that Mr orlowski finds a great partner is the biggest concern. One that perhaps his company would put an equity stake in immediately.
