I have looked at number of patent applications and I have yet to see any applications where the Extension of Time form and Fees were paid and no Arguments or Claims were submitted at the same time. On the other hand
I have seen the odd one where the Fees were submitted after the Arguments and revised Claims were submitted, but not the other way around.

North, having more experience with patents, have you seen this before.

In any event, with the Commercial Scale Production patent application. The examiners office granted the extension then contacted Dentons the following day to inquire on the missing documentation that normally accompanies a fee submission. Since nothing was being submitted at the time they assigned it a status of "Abandoned -- Failure to Respond to an Office Action", which was posted 7 days later.

If the examiner's office is consistent they should have contacted Dentons by now. Nothing has been posted, yet. Hopefully this week will provide clarity.

They had 6 months to file and pay a fee, but hold back the argument. It certainly looks like something may be in the works.
