Another (random) thought. We know that GERS filed an appeal with the Federal Circuit Court sometime after October 1, 2015 and that it was "deactivated" on June 21, 2016. We also know that when "reactivated" the appeal will carry the same case number (16-2231), unless the court orders otherwise. So, perhaps the "deactivated" filing is in fact the one that will be resurrected sometime in the future and thus they have already satisfied the 30 day filing requirement? It would be important to know more about appeal "deactivation" with the Federal Circuit, but we can find little on this subject despite extensive searching.
