Clearly the plaintiffs -Taub and gang - chose not hire an expert to write a report on the contract claim, or else PacerMonitor would have mentioned it.

This means - as I have noted several days ago - ARYC won't need to hire an expert either for their rebuttal!!

That means there is no need for a discovery phase on the expert reports, and so the partial dismissal decision is now at the Judge's discretion!!!

Let's hope -as I have noted- the case is adjudicated long before December 5th!!

What a disaster!!
