The affidavit of Herzog is very educational - Plaintiff failed to do any mediation before filing complaint, plaintiff failed to produce documents, plaintiffs failed to inform defendants of trial reset, plaintiff failed to follow through on agreement to change venue to New Jersey.plaintiff is dragging on trial by failing to commit to mediation, and defendants are demanding plaintiff produce proof of out of pocket damages as they had alleged in their multiple PRa.

Seth M. Shaw royalled F'ed up this lawsuit. Cowan is going to win.
