you are saying the lawyers for Fairholme and Perry are dumb and worse (for sure Fairholme attorneys talked with Perry attorneys before submitting - so you are condemning both sets of lawyers to the same stupidity cave)

I suggest you NOT over think it

There is an appeal that to some degree depends on intent of GOV and how far from being any sort of CONSERVATOR their actions have been

Material that is "in our favor" pushes the appeals court to tell the lower court - either you were flat out wrong and we over turn or over rule you - or to tell the lower court --- here is new information - review it and think again

Not more complicated than that . It is flat out bullish that this material - rushed to the attention of the appellate set of judges - got there in time
