A more telling reality is that Google is using the technology, patented it under their name (I guess they didn't feel it was invalid), and the technolgy has not yet been superceded.
Patent law and idea theft is very complex, and not limited to an awarded patent.
I believe Female Executive claimed that MAXD was only authorized to sue for trademark infringement. What trademark? Does anyone even know what the trademark is? If one does exist, what has Google gained from it? I'm personally unaware of anyone who uses the Google video products because they recognize and prefer a VSL/Vedanti trademark. As such, I can see the trademark being invalid.
