It makes no sense the way they did it. The way he phrased more than one email is that there was a list of shareholders who got money and some didn't.
That means....
Shares were used as a means of distribution
Although debt is secured...shares are not. No shareholder is any more important than the other when it comes to distribution of assets. Debtors are...but not shareholders of common stock.

The distribution was written in a letter. Anyone wanting to press this legally would have proof that they messed up.
