I don't even know where you are quoting from. Nor does it matter. Because I don't have all the facts. But it appears to me that the company was promised multiple times that the money would be wired. And such a boilerplate statement doesn't mean they will be excluded from all consequential damages. It only means, they are trying.
I told you before, leave it to the lawyers.

I don't even know why we are discussing the outcome of a potential lawsuit. Why is it important to you? Nobody even suggested that millions will be paid in damages. It's just a lawsuit like many others. Daily business. Obviously the company feels they may have case and should be compensated. Obviously it's very frustrating for management and the shareholders. But you seem to suggest that we should all take it on the chin and blame Chad for it. Well, that one won't fly. No doubt he will take part of the blame (because there is always some risk) but a big chunk goes to HN. For negligence, for breach of contract, for the things mentioned in the press release.
