Perhaps a typo but you said

should the patents expire before the ruling BRI would be used



This is incorrect.

How this works is ;

1. If patents expire before ruling = Phillips

2. If patents expire after = BRI

In our situation, it's so close it will be interesting to see what they use. I mentioned my thoughts on this in the previous post.
