I agree with all you said here and when I read that comment in the transcript it also gave me some cause for concern. However that comment "what would you like us to do" also could imply if you read it within the context of the line of questioning- it could suggest that the judge is saying "I don't really see how you have an argument, so what do expect of us here based on your argument not being convincing".

That is alternative interpretation I have thought about.
