Why is it that the SEC charged Tod DiTommaso and not Frederick Lehrer for the legal opinions rendered for FSPM?

Lehrer has probably done hundreds of bogus opinions. Just look at his track record with AZFL, Greencell etc... I guess this is another example of the SEC's revolving door selectively charging lawyers who render baseless opinions. Lehrer worked at the SEC and was an AUSA so he gets special treatment when he renders bogus opinions.

Anyone know the prosecutor in the criminal case?
