Those of you that have been around for a while know that I have been objectively critical of many, many aspects of GERS' management and performance. Keep that in mind when you read the following.

Yesterday's announcement is important. Buried somewhere in the archives of this board, when it engaged in substantive discussions about GERS, is a post from a learned individual, an IP attorney. In this post data were provided that demonstrated that the Appellate Court in DC, where this appeal will be heard, more often than not sided with the USPTO position when it conflicted with the lower court's decision. In this case GERS has clearly demonstrated what the USPTO position is and there will be no need for the Appellate Court to make interpretation of their intent. (Nevertheless, the USPTO allowed CleanTech’s patents after considering the very information that the court found to have been withheld from the USPTO, and upon which the bulk of the court’s recent ruling was based). Based on this history, GERS has a good chance of prevailing.

Those of you new to this gambit may not know that hundreds of millions of dollars in back royalties are at stake. I am not sure how/if KK would be able to manage this bonanza if they prevail -- he could well screw it up; and shareholders that have funded this "adventure" for so many years may still get the shaft. But that kind of revenue coming to a sub penny stock would in itself be noteworthy.
