Yes I agree with that. We can't control "gaming" but I liked the way our counsel laid out our arguments, handled the questions and was very clear in addressing issues.

I did find the line of questioning by the judges in Bungies rebuttal quite interesting. While I don't want to "get my hopes up"- that area is quite challenging to Bungies defense and interesting in that by that point the judges have heard what WDDD has to say.

I am at least happy that after reading the transcript, I do feel that our counsel (again not a lawyer but he "explained" the issues well enough for even me to understand better) did a hell of a job and left everything on the field as they in sporting terms.

I particularly liked that when one judge seemed to be wanting to interject with issues not argued or make "jumps" he called it out and reminded them how they are supposed to look at the case- that they can't "fill in the gaps with common sense" nor can they force wddd to "prove validity" but rather, it's BUNGIE that must prove invalidity.

Those reminders are important but also set up appeals if the judges fail to do their jobs properly.

If they do, I cannot see us losing here imho

It comes down to gaming or not now in my view.
