One of your best replies yet, Obit. Thank you. It's helpful to have someone with a legal background largely confirm my own thesis, essentially. Reading your words I am reminded how basic a problem lies at the core of these cases' results so far: an unwillingness by judges to consider the entirety of the law.

I, like others, am at least a little heartened by Sweeny's apparently two-sided and fair approach. But she is human also, and a Federal judge. I am starting to see in a whole new light why it is so difficult to defeat the government in court. I am starting to fear an AIG-like ruling that acknowledges the correctness of the plaintiff's claims but awards no accompanying economically beneficial result.
