I could be wrong, but I think what is being implied, is that if the A/S were raised, TCA would cram down some coversion as they have to right to do so without company approval. So until HHSE settles/finalizes whatever you want to call it with TCA, they can't lift the A/S.

But if and when they get past TCA, they will open the dilution spigot again.
