Cutting through the Court speak. The Cotter suit is about the lose of money by way of fraud. The same rules that the SEC has filed suit against Treaty and the gang of cons for violating.

With the motions filed by the defendants the burden of proof is placed on the defendants to prove they are innocent. they had no viable defense. Gwyn is in fact in default and was non responsive for a long time and filed an answer very, very late that has now been stricken. He's still in default.
