I don't think so. The ex parte motion is a motion to shorten the time required for notice, so that the motion to continue can be heard on short notice and before the trial starts. Without an order shortening time the motion would be scheduled after the trial, which would defeat the purpose of the motion altogether.

Dimension's motion is for a dismissal without prejudice of its remaining monetary claim (the other 8 having been dismissed). So far the indication is the Tmmi is not opposing this motion. Oddly I think.

Perhaps it would make sense to have a judge alone hearing but at the moment it's still scheduled for a jury, if it goes ahead as scheduled.
