I think the only reason this hasn't gone to trips yet is that there's still physical assets giving the company some residual value. The company as an operating entity is DOA and has been for a couple of years now. Of course, I think it would be pretty easy to argue that the current market value ($3M +/-) is still too high given the history of this fraud.
