It certainly came off as desperate by Bungie's attorney, but sometime that kind of stuff actually works. If you want to see a silver lining is that those tactics look desperate. Those are the kind of tactics you use when you don't feel you have enough facts to support your case.

Pesce is definitely an odd fellow, but regardless of his extra circular activities he and his partner at the time are responsible for VRML and there is no arguing that.

The issue regarding Bungie acting as a proxy is still on the table as well. I am sure there are people attending the oral arguments and I hope someone reports on it.
