As far as the Defendant goes, you do realize he can't be compelled to be deposed. I would argue against it, but he's willing to be. Kyle has no choice, so his "happy happy" response is meaningless. Let's see if he shows.

But what about the ClearTrust docs that were "allegedly" always available? Did Kyle ever turn them over so they could be reviewed? Didn't Kyle say only his brother has sold about 1MM shares and other relatives had not?

Has that been shown to be true or what?
