A California U.S. District Court ruled on June 30th 2016 in favor of Nery's election of "recission" of its contract for the purchase of Targa's stock. Nery's will surrender the stock to the court and Genesis Merchant ( who provided the funds to Sandro to buy/finance Targa from its original owners ) will deposit the money that Nery's claims it lost from Sandro's misrepresentations to Cathart on the finacials for Targa before the sale to Nery's was made.
The court ordered:
"The transfers of monies and the Targa stock shall occur within 60 days from the date of entry of this order; and
4) Nery's shall continue to operate Targa in good faith and in the ordinary course of business until the parties fulfill their mutual obligations identified herein."
It looks like Nascent owns Targa again....but there goes any hope of getting compensated with shares of Nery's Little Caesars....
Thought the group would like to know this.
