Clearly the operator has no control over what ERHC says months or years after a well is drilled. That is the same ridiculous assertion made by some up to 5 years after the JDZ was drilled. Yes the operator has control for a period of time during and after the well is drilled. But that period is not forever and ERHC has a legal obligation to disclose material events when the operator won't.

Every JOA ever written allows disclosures required by governmental regulations. This is just another attempt to justify ERHCs hiding of material information from their shareholders as they have often done. And everbody but a very few see it, know it and understand it
