I think his failure to negotiate a reasonable settlement with Wallace, with the end result of losing a large portion of the company speaks to his inability to negotiate.

The poor state of his tech is the larger problem with no revenues, not his negotiating skills, IMO. It would be like an 8 year old trying to negotiate the sale of their lemonade stand to Coke. They might be a great negotiator, but Coke wouldn't take it for free.
