Yes in the criminal case Michael Bongiovanni was sentenced to 3 years probation. He got off quite easy considering his crime. I'd love to see those sealed documents from the case to find out if they explain why he got off with such a light sentence.

Mike Bongiovanni pleaded guilty to Conspiracy to Defraud the United States on November 19, 2013. He was Sentenced in June of 2014.

But I've posted this link 2 times already and each time you must have missed it or failed to take the time to read it

http://nccpaboard.gov/wp-content/uploads/2015/05/05-2015-Activity-Review.pdf

After Michael Bongiovanni's conviction his conduct and subsequent guilty plea was reviewed by the North Carolina Board of Certified Public Accountants (the Board that oversees and regulates all CPA licensed individuals in North Carolina) in March of 2015.

It clearly states on page 2 that the North Carolina Board of Certified Public Accountants permanently revoked Mike Bongiovanni's CPA license and he is not allowed to act as a CPA in any state in any capacity.

After Micheal Bongiovanni had his North Carolina CPA license revoked he voluntarily relinquished his CPA license in the state of Florida

It looks like he might have been going up for a review with the Florida State Board of Certified Public Accountants as well but skipped the whole process and just surrendered his Certification without a review

I think this is the reason he changed the name of his accounting firm from Bongiovanni & Associates, PA to L&L CPAS, PA some time over the summer of 2015. His name is obviously tarnished and it could surely cause some issues if he is found acting as a CPA doing audits for public companies.

Most likely there is other certified accounts working in the firm, but I do still wonder if the SEC if fully aware of Michael Bongiovanni's legal issues and the loss of his CPA license.
