You're statement is uninformed and slightly misleading. This is not your fault as the "99.5% of all compassionate uses applications are approved" is a common misconception. There is an article out there that outlines the in depth process of the application process which starts first by patients, family members, the doc, and company contacting the FDA. Most attempts to file an application are STOPPED during this process. Companies who file for compassionate use have already been on contact will the FDA and given the nod to apply. I can't find the article right now but it is very detailed.

The way that you put it makes it appear that any biotech could apply for and get granted compassionate use for an investigational drug they have, which is clearly false.
