Even if that is the case, it is almost irrelevant. The simple reason for this is that the success of Biel on becoming a mega billion dollar company does not really depend on what the FDA does.

For example, I am now investing in Biel assuming no FDA. FDA is a huge bonus and one cannot deny it, but what is really happening overseas is where the cash flow and huge sale is coming from. In summary, with or without FDA clearance, Biel will be a huge company.

Having said all of that, FDA clearance to Class II prescription is pretty much guranteed after the latest changes on the FDA website. The only question remained is whether they allow OTC. You can see here that both scenarios are positive to Biel. Either way is good for Biel.
