PTSC case is not before the PTAB it is in the Federal Circuit Court of Appeals. How could any PTAB changes made by the Supreme Court regarding how they do their claims construction have an effect on PTSC? The issue in Cuozzo is that the PTAB (the newly set up Patent Trial and Appeals Board created by the 2011 America Invents Act) standard for claims construction is different that the District Courts standards. This might help PTSC but for the fact that the PTAB standards for claims construction are NOT what small patent holders want they want the district court standards and that is why Cuozzo appealed to the Supreme Court. The PTAB had crushed their patent and they wanted that reversed by the Supreme Court. Does anybody actually read these legal filings like Cuozzo or anything from PTSC? Just wondering because it seems like a lot of hope PTSC somehow succeeds without reading any of the vast amount of available information that says they will not.
