I find it very hard to connect-the-dots in any logical way and determine that plaintiff victory is in the air. The government could just as easily have decided to not file further briefs because it felt its initial filings were irrefutable. It also is a sign of respect for the court to NOT respond to every little chance for adding color to every matter.
